The free draft, the monthly plans, cancellation, and who owns what. No fine print you need a lawyer to read.

Section 01

The Agreement Between Us

These terms cover the free draft, the monthly plans, and everything else Code Camo does for you. By requesting a draft, signing up for a plan, or using a website we built, you are agreeing to them.

In these terms, "we" and "us" mean Code Camo, a veteran-owned web design business operating from Arizona. "You" means the person or business we are working for.

Section 02

The Free Draft

We build a real, custom website for you before you pay anything. It is not a template preview and it is not a mockup. Here is exactly what that means:

  • There is no cost and no card on file. You are not signing up for anything by asking for a draft.
  • We aim to deliver within seven days of our call with you. That is a target we hit the large majority of the time, not a guarantee, and it depends on you getting us the information and materials we asked for.
  • If you do not want it, you walk away owing nothing and there is nothing to cancel.
  • If you do not sign up, the draft stays with us. It is not published, not handed over, and not licensed to you. We may reuse the work.
Section 03

Who Qualifies

Code Camo is for the military community. Active duty, reserves, National Guard, and honorably discharged veterans of any branch qualify, and so do businesses those people own.

We confirm this on the way in, usually by asking a few questions on a call. We may ask for documentation. If it turns out someone misrepresented their service to get a veteran build, we can decline the work or end the plan, and we will.

Section 04

Plans, Pricing, and Billing

We offer two plans:

  • Core, $75 per month. A custom website build, hosting, a domain, unlimited updates, search engine optimization, a personalized dashboard, and site statistics.
  • Commerce, $99 per month. Everything in Core, plus a full online store with a cart and checkout.

How billing works

  • Billing starts when you approve your draft and the site goes live, not when you first contact us.
  • Plans are billed monthly in advance to the card you put on file, and renew automatically on the same date each month until you cancel.
  • Prices are in United States dollars.
  • If a payment fails we will let you know and try again. If it stays unpaid, we may suspend the site until it is settled.
  • We can change our prices, but never on an existing client without at least 30 days' notice by email. If you do not want the new price, cancel before it takes effect.
Section 05

Cancellation and Refunds

There is no contract and no minimum term. You can cancel any time by sending an email to robert@CodeCamo.com. We will confirm it in writing.

  • Cancellation takes effect at the end of the month you have already paid for. Your site stays up until then.
  • We do not issue refunds, including for partial months and for months in which you did not request anything. What you are paying for is the site being live, hosted, maintained, and available for updates.
  • When the paid period ends, the site comes down. The build, the design, and the code stay with Code Camo and are not transferred.
  • Your domain transfers to you. If we registered a domain as part of your plan, we will release it and help you move it to a registrar of your choosing at no charge. Registrars impose their own waiting periods on newly registered or recently transferred domains, and we cannot shorten those.
  • The content you gave us stays yours. Ask and we will send back the text and images you supplied.
  • If you come back later, we will be glad to have you, but the plan starts fresh.
Section 06

What Your Plan Includes

Unlimited updates

Unlimited means what it says: change text, swap photos, add pages, adjust your hours, add products, as often as you need, for as long as you are a client. There is no ticket allowance and no per-change fee.

What it does not mean is unlimited scope. An update changes or extends the site we built. Rebuilding the site from scratch, launching a second website, or adding a custom-built system that is not part of the plan is new work, and we will quote it before doing anything. We will always tell you which side of that line a request falls on before we start, never after.

Turnaround

Most updates go live within one business day. Larger ones take longer and we will tell you how long when you send them in.

Search engine optimization

Every site we build is put together to be found: clean structure, descriptive page titles and descriptions, structured data, fast pages, and content organized around what your customers actually search for. We keep working on it while you are a client.

Nobody can guarantee a search ranking, and we do not. Search engines change what they reward without telling anyone, and your competitors are working too. What we guarantee is the work, not a position.

Section 07

What You Are Responsible For

For this to work, a few things have to be true on your end:

  • The text, photos, logos, and anything else you send us are yours to use, or you have permission to use them. If you send us something you do not own, that is on you.
  • What we publish about your business is accurate. Your prices, hours, qualifications, licenses, certifications, and claims about what you do are yours to stand behind.
  • You hold whatever licenses and permits your trade requires, and your site does not claim credentials you do not hold.
  • You keep your account login to yourself and tell us if you think it has been compromised.
  • You come back to us within a reasonable time when we need something to move your project forward.
Section 08

Who Owns What

  • You own your content. Your words, photographs, logo, brand, product information, and customer data are yours and stay yours.
  • You own your domain. It is registered for you and it goes with you.
  • We own the build. The design, layout, code, and the custom components we wrote remain the property of Code Camo and are licensed to you for as long as you are on a plan. They are not sold or assigned to you.
  • We keep the right to show the work. We may display your finished site in our portfolio, on our examples pages, and in our marketing. Tell us if you would rather we did not and we will take it down.
Section 09

Third-Party Services

Your site runs on a website platform we license, your domain sits with a registrar, and your payments run through a payment processor. Those companies have their own terms, and your use of your site is subject to them as well as to these.

If one of them has an outage, changes a feature, or raises a price, we will do what we can, but their systems are not ours to control.

Section 10

Acceptable Use

We will not build, host, or maintain a site that is used to break the law or to hurt people. That includes anything unlawful, anything that infringes somebody else's copyright or trademark, deceptive or fraudulent offers, harassment, malware, spam, and adult content.

If a site crosses that line we will raise it with you first where we sensibly can. Where we cannot, we will take it down and end the plan.

Section 11

Availability and Support

We work hard to keep every site we host online and fast, and the platform we build on is built for exactly that. We cannot promise the internet will never have a bad day. Scheduled maintenance, platform outages, network failures, and events outside anyone's control all happen, and we do not offer credits or refunds for downtime.

Section 12

Disclaimers

We do our work carefully and we stand behind it. That said, the services are provided as they are. To the fullest extent the law allows, we make no other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that your site will be uninterrupted or error free, that every defect will be fixed, or that having a website will produce any particular number of visitors, leads, sales, or search rankings.

Section 13

Limitation of Liability

To the fullest extent the law allows, Code Camo is not liable for indirect, incidental, special, or consequential damages, or for lost profits, lost revenue, lost business, or lost data, arising out of your use of our services.

Our total liability for any claim relating to these terms or to our services is limited to the amount you paid us in the three months before the claim arose.

Some states do not allow certain limitations, so parts of this section may not apply to you.

Section 14

Indemnification

You agree to cover Code Camo for any claim, loss, or cost, including reasonable legal fees, that comes out of content you gave us to publish, a claim your site makes about your business, your use of the services in breach of these terms, or your breach of the law or of someone else's rights.

Section 15

Termination by Us

We can end a plan on 30 days' notice for any reason, and immediately if you breach these terms, if payment stays unresolved, if the veteran eligibility turns out to be misrepresented, or if the site is being used for something in the acceptable use section above.

If we end a plan without cause, we will refund the unused part of the month you have paid for. The cancellation terms above cover what happens to the site and the domain.

Section 16

Changes to These Terms

We update these terms from time to time and the date at the top of the page changes with them. If a change materially affects existing clients, we will email you at least 30 days before it takes effect. Staying on your plan after that date means you accept the new terms.

Section 17

Governing Law

These terms are governed by the laws of the State of Arizona, without regard to its conflict of law rules. Any dispute that cannot be worked out between us goes to the state or federal courts located in Maricopa County, Arizona, and we both agree to that venue.

Before anyone files anything, we both agree to pick up the phone and try to sort it out first. That has worked every time so far.

Section 18

The Rest

  • These terms, together with our privacy policy and the plan you signed up for, are the whole agreement between us.
  • If a court finds part of these terms unenforceable, the rest still stands.
  • If we do not enforce something right away, we have not given up the right to enforce it later.
  • You cannot transfer your plan to someone else without our written agreement. We can transfer ours if the business changes hands.
  • Nothing here makes either of us the other's employee, partner, or agent.
Section 19

How to Reach Us

Questions about these terms, or about anything else:
